New EU law could endanger lives of children, says professor - The Herald
EU legislation that will become law in the UK next month will remove vital safeguards on child abduction and could have dangerous consequences, ac-cording to a leading government adviser.
Professor Paul Beaumont, head of the school of law at Aberdeen University, has warned that the Brussels regulation covering divorce and family law which will be introduced across almost all the member states could endanger the lives of children.
Known as Brussels IIbis, the regulation will mean decisions taken in a member state in relation to divorce and custody will be enforced by every other member state and introduces provisions for the return of children from one member state to another.
The regulation will remove the power of a Scottish court to overrule the custody decision of a court in another member state – even if there is proof the child faces abuse.
